Copyright Policy

1. Our own content

The Fromerica name, logo, wordmark, and the design, layout, software, text, and graphics of the Platform that were not submitted by users (collectively, "Fromerica Content") are owned by Fromerica LLC or its licensors and are protected by US and international copyright, trademark, and other intellectual-property laws. Fromerica Content may not be copied, reproduced, distributed, modified, or used to create derivative works without our prior written consent, except as strictly necessary to use the Platform as intended (for example, viewing pages in your browser) or as permitted by our published API terms.

2. Content submitted by users

Product images, company descriptions, profile photos, testimonials, reviews, and other material submitted by Exporters, Importers, and Professionals ("User Content") remain the property of the user who submitted them, subject to the license granted to Fromerica under Section 4 of our Terms of Use. Every user who submits content to the Platform represents and warrants that they own it, or have obtained all necessary rights, licenses, and permissions to publish it and to grant Fromerica the license described in our Terms. Fromerica does not review User Content for copyright ownership before it is published and assumes no responsibility for infringing User Content, consistent with Section 4 of the Terms of Use and our Listing & Content Terms.

3. Reporting copyright infringement (DMCA notice)

Fromerica respects the intellectual-property rights of others and responds to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act, 17 U.S.C. § 512 ("DMCA"). If you believe content on the Platform infringes your copyright, send a written notice to our designated agent that includes all of the following:

(a) a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material claimed to be infringing and its location on the Platform (a URL is sufficient), with enough detail for us to locate it; (d) your contact information (name, address, telephone number, and email); (e) a statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law; and (f) a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Incomplete notices may not receive a response. Submitting a knowingly false or bad-faith takedown notice may expose you to liability under 17 U.S.C. § 512(f).

4. Counter-notice

If you believe content you posted was removed or disabled by mistake or misidentification, you may submit a counter-notice to the same address containing: (a) your physical or electronic signature; (b) identification of the removed material and where it appeared before removal; (c) a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification; (d) your name, address, and telephone number; and (e) a statement that you consent to the jurisdiction of the federal court in the district that includes your address (or, if outside the United States, Miami-Dade County, Florida) and that you will accept service of process from the person who filed the original takedown notice. Upon receiving a valid counter-notice we may, at our discretion and as the DMCA allows, restore the material unless the original complaining party informs us that it has filed a court action.

5. Repeat infringers

We may, in our sole discretion, suspend or terminate the account of any user who is the subject of repeated, credible infringement notices, consistent with the DMCA and our Terms of Use.

6. No obligation to monitor

Fromerica has no obligation to proactively monitor User Content for copyright infringement. Nothing in this policy creates any duty, express or implied, on Fromerica's part to review, screen, or pre-approve content before publication.
